This document constitutes the Terms of Service for www.app.goseetalents.com and more generally of the service provided by Go See Talents AB (hereinafter referred to as “Go See Talents”).
It should be noted that Go See Talents’ Terms of Service may be modified at any time: users are therefore invited to consult them on a regular basis.
Go See Talents offers a service connecting Companies which want to hire Talents with Talents who want to land their next dream job, all through www.app.goseetalents.com (hereinafter referred to as the “Service”).
“Talent” refers to any natural person which requests its registration on the Service in order to register their CV and to find new professional opportunities there.
”Company” refers to any natural or legal person which requests its registration for the Service in order to search Talents, be matched with Talents and to hire Talents.
“User” refers to any natural or legal person (Company or Talent) which is using the Go See Talent’s Service.
The Talents and the Companies interact on the Service by means of their Profile.
“Profile” refers to all content (information and any file including photos, curriculum vitae, etc.) published by a Talent or by a Company in order to present itself and to interact on the Service.
“Employment Agreement” refers to any agreement for employment which may be entered into by a Talent and a Company.
“Agreement” refers to any agreement which may be entered into by a Talent and a Company.
“Paid subscription” refers to any of the subscription plans for Talents or Companies which are in connection with a charge.
By completing the registration process, by accepting the terms and conditions and being approved by Go See Talent, you will be able to use the service. When you register, you are making the following declarations:
you are of legal age to enter a contract with Go See Talents.
you have the authority to enter a contract in a personal capacity or on behalf of the company mentioned at the time of your registration.
As a user, using the service, you hereby accept that Go See Talents may contact you to provide feedback on your Profile.
2. Provisions applicable to the Talent
2.1 Registration process
At the time of your registration, you will be asked to complete your Profile. For Talents this means entering your name, contact details, your educational background, your professional experience, your skills and by attaching photos and videos of yourself.
Talents will also have the opportunity to be invited for different kinds of tests (e.g. technical tests) which intentions are to strengthen the Profile and to verify the stated skills. Furthermore, Talents will have the opportunity to be invited for an on-demand video interview. All tests and video interviews are provided through 3rd party services.
In order to ensure the reliability of the Service, you shall undertake, upon your registration (i) to provide only information about your situation which is accurate, given in good faith and up-to-date, and to provide your true identity (ii) never to hold more than one account on the Service. We may also allow you to use a third-party service such as e.g. LinkedIn to register. If you do so, you confirm that the information contained in such third-party services is current and accurate and can be used for the purpose of your registration under these ToS.
Go See Talents reserves the right to request, at any time: A document proving your identity. In the event that, despite such a request, such documentary proof is not provided, Go See Talents reserves the right to suspend or delete your account.
We will review the information you provide us with during the registration process and we may also examine any other information about you that is publicly available. It is also possible that Go See Talents may contact you, in order to discuss your Profile, before approving your registration.
However, Go See Talents reserves the right, at its sole discretion, to accept or refuse any request for registration to the Service, in particular after having consulted the information about you which is freely available.
If your registration is accepted, you will be allowed to use our Service.
2.2 Contractual freedom of the Talent
Registration on the Service and access to the Service do not give rise to any obligation of the Talents to accept a contact request or interview invitation from a Company of any kind whatsoever. Nor does it give rise to any obligation to enter into an Employment Agreement between the Talent and a Company.
Only the conclusion of an Agreement between yourself and a Company will create mutual obligations. The terms of the Agreement (remuneration offered, duration and type of mission) shall be freely discussed by the Talent and the Company, without Go See Talents’ involvement in this discussion.
2.3 Go See Talents Feedback
As a Talent using our Service, you accept that Go See Talents may contact you to provide feedback on your Profile.
3. Provisions applicable to the Company
3.1 Registration process
At the time of your registration, you will be asked to enter some data about yourself and your company, e.g. company name, your name and your email address.
In order to ensure the reliability of the Service, you shall undertake, upon your registration (i) to provide only information about yourself which is accurate, given in good faith and up-to-date, and to provide your true identity (ii) never to hold more than one account on the Service. We may also allow you to use a third-party service such as e.g. LinkedIn to register. If you do so, you confirm that the information contained in such third-party services is current and accurate and can be used for the purpose of your registration under these ToS.
Go See Talents reserves the right to request, at any time: A document proving your identity and your connection to the specific company.
In the event that, despite such a request, such documentary proof is not provided, Go See Talents reserves the right to suspend or delete your account.
We will review the information you provide us with during the registration process and we may also examine any other information about you that is publicly available. It is also possible that Go See Talents may contact you before approving your registration.
However, Go See Talents reserves the right, at its sole discretion, to accept or refuse any request for registration on the Service, in particular after having consulted the information about you which is freely available.
If your registration is accepted, you will be allowed to use our Service.
3.2 Contractual freedom of the Company
Registration on the Service and access to the Service do not give rise to any obligation of the Company to enter into a dialogue with a Talent. Nor does it give rise to any obligation to enter into an Employment Agreement between a Talent and the Company.
Only the conclusion of an Agreement between your Company and a Talent will create mutual obligations. The terms of the Agreement (remuneration offered, duration and type of mission) shall be freely discussed by the Talent and the Company, without Go See Talents’ involvement in this discussion.
3.3 Service providers
Go See Talents has a number of quality assured service providers with which Go See Talents can put your Company in touch with, on your request. These service providers provide a number of different services such as for example remote set-ups
and relocation services.
The service providers are available for Companies on paid subscriptions only. Companies on paid subscriptions can freely discuss and go into Agreements with any of the service providers with regards to the talents registered and available
through the Go See Talents Service. Companies understand that they may only go into Agreements regarding remote set-
ups or any kind of hiring with Service Providers for talents that are registered in the Go See Talents Service. Companies are not allowed to request Service providers to send or share available talents directly to the Company. The Company understands
that all talents which the Company wants to assess for a possible hire of any kind through Service Providers, shall be registered in the Go See Talents Service.
If a Company, being on the free subscription plan, wishes to employ or otherwise consult a Talent provided through the Go See Talents platform within a period of six (6) months of that Talent having been provided for the Company, then the Company
must pay a subscription fee equivalent to the current price of the basic or premium plan for 12 months. The six-month period for presented Talents who have never been hired or employed by the Company, is calculated from the day the candidate was viewed by the Company.
If the Company violates the provisions of the Hiring, then a penalty of three (3) times
the yearly basic subscription fee is payable. For the items Hiring above, “Company”
also means other companies within the group of which the Company is part, as well
as the Company’s customers and suppliers, in the event that the Talent provided has
been passed on to the latter by the Company.
4. General Provisions
4.1 Functioning of the Service
Go See Talents is a service to Companies which is intended to enable you to search and be matched with Talents, with the intention to eventually hire a Talent.
Go See Talents is a service to Talents which is intended to enable you to create and share your professional digital resume/CV as well as being matched with potential employers, with the intention to eventually become hired.
After registering yourself on the Service and once your registration has been approved by Go See Talent, you will be able to use and benefit from the Service.
4.2 Content published by users
Users are hereby strictly prohibited from publishing content which does not conform to the legislation in force, including in particular (but not limited to) the following:
any content which may be illegal, degrading, violent, threatening, defamatory, offensive, obscene, contrary to accepted principles of morality, hateful, racist, xenophobic, antisemitic, sexist, which may amount to harassment, discrimination, which may infringe another person’s private life, human dignity, respect of personal data, confidentiality or secrecy of correspondence or which may promote illegal activity.
any content violating the intellectual property rights of another person;
any content which is incorrect or falsified, in particular in relation to users’ identities and their educational and vocational qualifications;
If Go See Talents is informed or considers that a user of the Service or a content does not comply with the law or these ToS, Go See Talents reserves the right to delete all or part of the Profile or the contentious content, and/or to suspend or delete the user’s account from the Service, and/or to moderate any contentious content without prior notification.
You must alert Go See Talents if you come across a Profile or any other visible content on the Service which is patently unlawful or violates these ToS by sending a message to the following address: firstname.lastname@example.org.
4.3 Use of the Service
You are required to use the Service without seeking to harm the Service and without exceeding the functions proposed. In particular, you hereby undertake:
Not to contravene the requirements, procedures, policies or regulations of third-party services used by the Service;
Not to copy, not to distribute and not to disclose any part of the Service by any means whatsoever (expect of course the built-in sharing function);
Not to download, not to publish, not to transmit or disseminate media containing viruses or any other computer code, file or programme designed with the aim of interrupting, impeding or restricting the proper functioning of any software, material or other equipment relating to telecommunications;
Not to interfere with or impede the functioning of the Service or its servers;
Not to go beyond your user prerogatives, for example by attempting to use tools to which you do not have access or by erasing, adding or modifying Service content;
Not to imitate or usurp the identity of a Talent, Company or any other person affiliated with Go See Talents;
Not to sell and not to transfer your account to third parties;
Not to employ practices which could resemble spam, or which would not be fair, such as the promotion of a website through false links, or the promotion of your own website or business by publishing advertisements in your profile.
4.4 Subscription charges
As a Talent or a Company, you choose a type of subscription at time of sign-up. Subscription plans and details can be found here https://www.goseetalents.com/prices.
If you don’t choose one of the paid subscriptions, you will be automatically placed in the free subscription plan where no charges will be made.
Any campaign and its specific terms and conditions will be clearly stated separately, for that specific campaign.
You may purchase a Paid Subscription either by (1) paying a subscription fee in advance on a monthly basis or, (2) paying a subscription fee in advance on a yearly basis.
Go See Talents may change the price for the Paid Subscriptions, including recurring subscription fees, from time to time and will communicate any price changes to you in advance and, if applicable, how to accept those changes. Price changes will take effect at the start of the next subscription period following the date of the price change.
You accept the new price by continuing to use the Service after the price change takes effect. If you do not agree with a price change, you have the right to reject the change by unsubscribing from the Paid Subscription prior to the price change going into effect.
4.6 Subscription renewal/cancellation
For your Paid Subscription, your payment to Go See Talents will automatically renew at the end of the applicable subscription period, unless you cancel your Paid Subscription before the end of the then-current subscription period.
The cancellation will take effect the day after the last day of the current subscription period, and you will be downgraded to the Free Service. We do not provide refunds or credits for any partial subscription periods.
4.7 Upgrade/downgrade of subscription plan
An upgrade of your subscription will take effect as soon as Go See Talents has received and processed such request.
A downgrade of your subscription will take effect the day after the last day of the current subscription period.
4.9 Suspension of access – Termination
4.9.1 On the initiative of Go See Talents
In general, in the case of a breach by a user of one of its obligations specified in these Terms of Service, Go See Talents reserves the right to suspend or delete its account and its capacity to use the Service at any time, automatically and without judicial formality.
Go See Talents reserves the right to downgrade, suspend or delete a user account in the case that the user does not fulfil its obligation to pay the subscription charges on time.
4.9.2 On the initiative of any User
If you no longer wish to use the Service and the Service, you may request the termination and deletion of your account by sending an email to email@example.com. Your request will be adhered to promptly and you will receive a confirmation email from Go See Talents.
As a Talent, you can at any time make your Profile private which means no one but yourself can access and view your Profile.
4.9.3 Effects of termination
Notwithstanding such termination, the provisions of these ToS, in relation to the period prior to the termination, will continue to apply.
4.10 Go See Talents’ duties
4.10.1 Accuracy of the information provided by the Users
Although Go See Talents examines the content published by the users and reserves the right to screen, modify, suspend or delete without notice any account linked to a Profile containing inaccurate information, Go See Talents does not guarantee the accuracy of such content and information.
More specifically, Go See Talents does not guarantee under any circumstances that it will conduct any investigation into the experience claimed by the users, or the information and content provided.
Go See Talents cannot under any circumstances be held liable on the basis of information and content which may be found to be incorrect or unlawful.
It is therefore incumbent on the Companies alone, if they so wish, to carry out an investigation or to employ all reasonable endeavours to verify the attributes and experiences of the Talent.
4.10.2 Use of third party services
The Service allows the publication and display of content from third party services. Go See Talents bears no responsibility to the users, or to third parties, for such content.
4.10.3 Absence of guarantee from Go See Talents
Go See Talents does not under any circumstances guarantee the conclusion of employment agreements between Talents and Companies.
Any exchange, and any promise to enter into an Agreement which may be signed between a Company and a Talent is the sole responsibility of these parties and excludes that of Go See Talents.
More generally, Go See Talents cannot be held responsible for any damage, whether direct or indirect, resulting from any communication, interaction, relation, agreement or dispute between Talents and Employer. In particular, Go See Talents, which is not party to the Agreement, cannot be held liable in the event of non-performance, poor performance, or termination of the Agreement by the Company or the Talent.
4.11 Availability of the Service
Go See Talents cares about its users and strives for very high availability of the Service.
Go See Talents reserves the right for any reason whatsoever, in particular taking into consideration technical and/or computer and/or telecommunication and/or maintenance difficulties and/or constraints, and cases of major force, to interrupt at any time and where appropriate without notice, access to the Service, to end or modify the features of consultation of the Service, it not being possible to hold Go See Talents liable for the consequences arising from such interruptions or modifications.
More generally, Go See Talents reserves the right to make any modifications of any kind whatsoever to the Service’s content.
4.12 Force majeure
Go See Talents will be released from any liability if the non-performance of one or all of its obligations as specified in these ToS, results from a case of force majeure.
For the purposes of these ToS, “force majeure” is defined as any circumstance not within a party’s reasonable control including, without limitation, flood, drought, earthquake or other natural disaster; epidemic or pandemic; terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; nuclear, chemical or biological contamination or sonic boom; any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition; collapse of buildings, fire, explosion or accident; and any labour or trade dispute, strikes, industrial action or lockouts.
If the performance of the Service in accordance with these ToS or any of Go See Talents’ obligations under these ToS is prevented, limited or disrupted due to a case of force majeure, Go See Talents will be released from performance of the contractual obligations concerned.
4.13 Legal notices
Go See Talents is incorporated and registered in Sweden with company number 559109-0054, whose registered office is at Convendum, Västra Järnvägsgatan 3, 111 64 Stockholm, Sweden.
4.14 Intellectual property
The Go See Talents company trademark, all other trademarks, whether figurative or not, illustrations, images, texts, commentaries and logos on the Service, regardless of whether they are registered or not, the general structure of the Service, as well as software texts, still or moving images, know-how, designs, illustrations, database and any other elements of the Service are and will remain Go See Talents exclusive property.
The same applies to any copyright, design, model and patent which are the property of Go See Talents. Any reproduction in whole or in part, modification, removal or use, for any reason and on any media whatsoever, without Go See Talents express prior agreement, is strictly prohibited.
Hyperlinks to other third-party internet sites or third-party services may be available on the Service through Go See Talents Profiles. Go See Talents has no power of
control over these internet sites or their content. The publication of links to such other internet sites does not indicate under any circumstances that Go See Talents approves such sites or the contents, products or services which they propose.
4.16 Personal data
By carrying out your registration, you agree to the storage, processing and use by us of the data collected on this occasion. The information about you is intended for use by yourself, Talent and Company and by Go See Talents.
Unless otherwise agreed, Go See Talents can cite the name of any Company registered on the Service in any document, whether in electronic or other form, as a reference.
Go See Talents reserves the right to freely sub-contract all or part of the services assigned to its Service.
4.19 Miscellaneous provisions
These Terms of Service of Go See Talents’ Service may be modified at any time: users are therefore invited to consult them on a regular basis.
Where important or significant modifications are made to the Terms of Service of Go See Talents’ Service, the page containing the ToS will be updated on the Service. If you are registered on the Service, we will also notify you by electronic mail of any modification. Any modification of the ToS will immediately come into force in relation to new users of the Service and will come into force thirty (30) days after publication of the new ToS for existing users. If you refuse the new ToS after having been notified of a modification, you will be required to stop using the Service. Failing that, your continued use of the Service will constitute acceptance of such change(s).
These ToS supersede the previous versions of Go See Talents’ ToS.
The invalidity of one of the clauses of these ToS will not give rise to the invalidity of the other clauses of these ToS which will remain in force to their full extent between the parties.
The fact that Go See Talents does not invoke at a given time any of the clauses of these ToS, and/or a failure by the User to fulfil any of its obligations under these ToS cannot be interpreted as a waiver by Go See Talents of the right to subsequently invoke any of these clauses or contractual obligations.
Accordingly, unless formally agreed in writing by Go See Talents, no specific term can take precedence over these ToS. Any contrary term raised by a User will therefore, in
the absence of express acceptance, be unenforceable against Go See Talents, regardless of when it may have been brought to its attention.
4.20 Applicable law and election of jurisdiction
These Terms of Service are governed by the laws of Sweden and any dispute about the validity, interpretation or termination of the Terms of Service will be subject to the exclusive jurisdiction of the courts of Sweden.
